Would Insomniac Spider-Man Have Taken Iron Man's Side in Civil War?

Someone asked this on reddit and I wanted to bring it here. 

Firstly, in the movie, I feel Tony really only cared about Cap not signing the Accords bc of Bucky killing his parents and Steve knowing about it. Like I feel like if Tony didn't know he would have just acted like he was helping Ross while letting Cap and everyone else leave. And if he was to find out while they were on the run he woulda found Cap immediately. I'm pretty sure that's not how it went in the comics but I feel like it just makes sense. But if we were just going off comics (either sign and unmask basically or you are like a "fugitive" or "outlaw" or w/e) then I feel like Spider-Man will always be on Caps side. I know Insomniac SM hasn't had any crazy threats against the few ppl that know his secret. but he would definitely know its bc barely anyone knows. He only ever told MJ over the 10+ years he's been SM and she's constantly putting herself in danger.  I feel like Tony gave Peter like only part of the story in the movie, especially with the way he explained it to Cap when he asked. So yeah my two cents. I'm curious if anyone can find reasons to be on Caps side besides just wanting to "do what's right" in a legal sense I guess.
